The platforms are provided "as is" without guarantees of uninterrupted service, security, or error-free operation. Simply Gut Health is not liable for any indirect, consequential, or punitive losses, except in cases of negligence causing death or personal injury.
1.7. Force Majeure (Unforeseen Events)
Simply Gut Health shall not be liable for delays or service disruptions caused by events beyond our control, including but not limited to: Natural disasters (floods, fires, earthquakes), Pandemics or public health emergencies, Government regulations or restrictions, Cyberattacks, power outages, or technical failures, Strikes, labour disputes, or supplier failures.

Simply Gut Health reserves the right to terminate services if a customer engages in abusive, fraudulent, or unlawful behaviour, fails to provide accurate information or comply with service requirements or violates these Terms and Conditions.
1.10. Dispute Resolution
If a dispute arises, customers must first contact us at info@simplyguthealth.co.uk to seek resolution. If unresolved, both parties agree to attempt mediation before taking legal action.
1.11. Governing Law
These Terms and Conditions are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the English courts.
2. Clinical and Therapy Appointments
2.1. Booking and Payment
Full payment is required at the time of booking an initial appointment. If you cannot attend, at least 48 hours’ notice must be given via email.
2.2. Course Enrolment and Suitability
After the initial appointment, your suitability for a therapy course will be assessed. You will either be:
Invited to join a course, or provided with a detailed letter outlining the outcome.
2.3. Documentation and Compliance
Pre-assessment forms must be completed before your first session. Failure to complete forms or comply with course guidelines may result in cancellation without a refund.
2.4. Course Fees and Pricing
Course prices are subject to change without notice.
2.5. Attendance Policy
Failure to attend scheduled appointments once a course has started will result in no refund.
2.6. Medical Advice
Simply Gut Health does not provide medical diagnosis. You should consult a doctor before starting treatment. By booking, you confirm that pre-assessment forms have been completed truthfully.
3. Reporting Services
3.1. Currency and Fees
Payments made in non-GBP currencies will incur a conversion fee, which will be provided at the time of pricing. This fee is non-refundable.
3.2. Report Processing and Turnaround Time
Reports are processed within 14 days after receiving both the required data and full payment. Customers may request expedited processing for an additional fee. However, we reserve the right to refuse acceleration, even if the fee is paid. If refused, the acceleration fee will be refunded.
3.3. Data and Payment Handling
Data is retained for 14 days from receipt. If full payment is not received within this period, all submitted information will be permanently deleted. Payments are held for 14 days. If the required data is not received within this period, 50% of the payment will be refunded, with the remaining 50% retained as a non-refundable deposit.
3.4. Report Compatibility and Additional Fees
Simply Gut Health can only process reports from compatible systems, specifically Laborie equipment. If other systems are used, additional fees may apply to cover equipment or software rental, and in some cases, travel expenses. These costs will be provided at the time of pricing.
3.5. Refunds
Refunds will be processed via the original payment method within 30 days. The conversion fee for non-GBP payments is non-refundable.
3.6. Reporting Standards and Clinical Responsibility
Simply Gut Health processes and interprets reports in accordance with UK guidelines and adheres to any standardised classifications that are defined as gold standard, whether UK-based or international. Our reports provide objective findings based on the data received, but they do not constitute medical diagnoses or treatment recommendations. It is the responsibility of the patient’s clinician to exercise professional judgement in interpreting and applying our findings within the context of their clinical decision-making.
4. Confidentiality, Data Retention, and Child Protection
4.1. Data Protection and Privacy
Simply Gut Health complies with UK data protection laws. We do not share customer data with third parties. Personal data is stored securely and used only for service-related purposes.
4.2. Confidentiality of Therapy Sessions
Therapy records are strictly confidential and only accessed by authorised staff. Clients may request a copy or deletion of their records, subject to legal requirements.
4.3. Retention of Records (Children’s Health Records)
Simply Gut Health retains children's health records as required under UK governance laws. Records are securely stored and only deleted when legally permitted.
4.4. Child Protection and Safeguarding
Simply Gut Health is bound by UK child protection laws. If we believe a child is at risk of harm, neglect, or abuse, we are required to escalate concerns to the relevant authorities, including; Social Services, The Police, Health Visitors or other safeguarding professionals
5. No Guarantee of Results
Simply Gut Health makes no guarantees regarding the effectiveness of therapy or reports. Results depend on individual health conditions, adherence to therapy recommendations, external factors beyond our control.
Simply Gut Health is not liable for any adverse reactions, injury, or illness resulting from the preparation or consumption of any recipes shared via our website, social media, or printed materials.
